通过对路怒症典型案件梳理分析,发现涉案主体多为青壮年男性、普遍存在焦虑心理、起因多为行车纠纷、行为具有暴力攻击性、案件取证较为困难等基本特征。目前,对于路怒类警情尚无统一的认定裁量标准和处理程序规定,亟待从标准和程序两个维度对其进行法律规制。路怒症涉及的常见罪名包括危险驾驶罪、寻衅滋事罪等,司法实践中应当加以细致甄别、准确适用。办理轻微刑事案件的指导意见是路怒类警情的快速处理依据。

By analyzing the typical cases of road rage,the paper finds that most of the subjects involved in the case are young and middle-aged men,anxiety is prevalent,the causes are mostly traffic disputes,violent and aggressive behavior,and the case is difficult to obtain evidence.At present,there is no uniform judgment standard and procedure for road rage,so it is urgent to regulate it from the two dimensions of standard and procedure.The common crimes of road rage include dangerous driving crime,picking quarrels and provoking trouble,which should be carefully and accurately applied in judicial practice.The guiding opinions for handling minor criminal cases are the basis for the rapid handling of road rage police cases.
