刑事诉讼涉案财物管理工作体系建设初探——以上海市公安局浦东分局为例

Initial Probe into the Development of Property Management system in Criminal Procedure--Taking Pudong Branch of Shanghai Municipal Public Security Bureau as an Example

近年来,全国各地公安机关在涉案财物管理工作方面进行了大量有益的探索,取得了很多成功经验,但是也面临诸多问题。结合新刑事诉讼法司法解释精神,深入推进刑事诉讼涉案财物管理工作体系建设的对策主要有:建立分级共管工作机制,降低司法运行成本;统一建设标准、工作流程和保管要求,打造分储式和集约化的共管中心;对涉案财物执法工作加大监督力度,明确涉案财物处置结果等。

In recent years,police agencies throughout the country have explored a lot in the management of property that involved in the cases,and therefore have achieved much successful experience,but also encountered many problems.Based on the legislative spirit of New Interpretation on Judical Procedure Law,countermeasures to further promote the development of the management system of property involved in criminal proceedings go as follows:establishing a hierarchical management mechanism to reduce the cost of judicial operation;unifying the development standards,work procedures and storage requirements to set up a storage and intensive management sub-center;strengthening the supervision of the law enforcement in dealing with property involved in the case,and clarifying the responsibility of disposing such property.
