自贸试验区背景下行政公益诉讼的思考

实现国家利益与社会公共利益的无漏洞保护以及自贸试验区的特殊性直接要求行政公益诉讼在区内开展须遵循特殊的路径,其中预防性行政公益诉讼就是契合其探索性与改革性的出路。预防性行政公益诉讼是指在国家利益和社会公共利益遭受实际侵害的结果发生之前,经科学化与民主化的综合判断,损害结果必然会发生或发生的可能性极大的情况下,检察机关出于保护国家利益和社会公共利益的需要而依法启动行政公益诉讼程序的制度。通过立法授权或司法解释的方式确立在自贸试验区内开展预防性行政公益诉讼,将有助于新时代促进政府依法行政、充分发挥检察机关法律监督职能与实现国家治理体系和治理能力现代化,同时也将为当前全国各自贸试验区的有序发展、高效运行提供助力。

To realize the non-loophole protection of the national interest and the social public interest and the particularity of the pilot free trade zone directly require the administrative public interest litigation to follow a special path in the zone,among them,the preventive administrative public interest litigation is the way out for exploration and reform.The preventive administrative public interest litigation refers to the scientific and democratic comprehensive judgment before the actual violation of the national interest and the social public interest occurs,under the circumstance that the damage result is inevitable or probable,the procuratorial organ starts the administrative public interest litigation procedure according to law for the need of protecting the national interest and the social public interest.The establishment of preventive administrative public interest litigation in the pilot free trade zone by way of legislative authorization or judicial interpretation will help the new era to promote government administration in accordance with the law,give full play to the procuratorial organ’s legal supervision function and realize the modernization of national governance system and governance capacity.At the same time,it will provide impetus for the orderly development and efficient operation of the current national pilot free trade zones.
