我国民事“执行难”问题的法律探究

民事执行是司法实践环节当中,维护当事人民事权利和民事权益的一种法律途径,也是社会公平正义最具体的体.现。但是在司法实践当中,民事执行的过程却常常遭遇困境。执行工作难以开展、执行人难找、财产执行效果甚微都是当今民事执行所面临的难题。论文围绕我国民事执行的现状,从法院执行工作的开展入手,深入挖掘“民事执行难”的原因,结合新疆基层法院的民事案件执行工作的开展,对这一现象的表现进行深入分析,紧密联系实际情况,希望得出解决相关问题的方法,为我国司法机关民事执行难的问题提出合理的建议和更为完善的制度。

Civil execution is a legal way to safeguard the civil rights and interests of the parties in the course of judicial practice, and also the most concrete embodiment of social fairness and justice.But in the judicial practice, the process of civil execution often encounters difficulties.The current problems of civil execution are difficult to carry out the enforcement work, difficult to find the executor and poor execution effect of property.This paper focuses on the current situation of China’s civil execution, starting from the development of the court’s execution work, deeply excavates the reasons for the difficulty in civil execution, combines with the development of the civil case execution work of the grass-roots courts in Xinjiang, deeply analyzes the performance of this phenomenon, and closely links with the actual situation, hoping to find out the methods to solve the relevant problems, so as to put forward reasonable suggestions and more perfect system for China’s judicial organs to solve the problem of difficult civil execution.
