论高职学生教育管理的法治化问题与解决对策

On the Legalization of Education Management of Higher Vocational Students and Its Countermeasures

依法治校已成为学校治理的必然选择,但实践中的治理效果仍需完善。以高职学生教育管理为例,法治建设存在管理过程行政化,法治教育形式化,行为管理边缘化,规章制度模式化等问题。建议理顺学校-学生关系,确保校园法治制定的合法性、与上位法的协调性、管理过程的程序性,加强校园法治建设的参与度、公开性、透明性,加强师生法治意识等。

Governing the school according to the rule of law has been the inevitable choice of school gover⁃nance.However,the governance effect in practice is not satisfying.Illustrated by the education management of higher vocational students,some problems in the law construction are clarified as follows.The management is mainly based on administrative means;there is a lack of procedural awareness;students have little concept of law;human relationship is superior to the law;the school system is fuzzy with weak operability,and can not be strictly implemented according the higher-level law.Also,in the paper,some suggestions are proposed to solve the problems:the relationship between school and students should be rationalized;the participation,openness and transparency of the campus rule of law should be strengthened with the legitimacy of the campus rule of law,the compatibility of the higher-level law and the procedure of the management;the teachers and students’awareness of the rule of law should be improved.
