司法对话构建全球宪法习惯的路径

摘要 分散的法律权威与国际法碎片化导致无法通过结构主义宪制的方式解决法律冲突。权威的分裂性和排他性是产生法律多元主义的根源。①除非有特殊的域内法条款,否则国家以主权的名义拒绝域外法规范的域内效力。然而,现今许多国家宪法法院或最高法院在解释和适用基本权利条款时青睐比较法。法官在全球化时代下通过援引域外判决②,为建构基本权利解释的"共识性"③和塑造"万民法"提供了可能。
