智能技术在给人们的生产和生活带来便利的同时,也给部分人设置了隐形障碍。运用可行能力理论对智能技术设置的隐形障碍进行分析可知,人们在智能技术使用中存在的差异本质上是人的可行能力不平等,包括内在的能力不平等和外在的自由与机会不平等。内在能力不足和自由与机会缺乏并不是由当事人自身的原因造成的,而是由当事人以外的原因造成的,即内在能力不足和自由与机会缺乏不是当事人“应得”的,据此可以判定,智能技术使用中存在的可行能力不平等是不正义的。对于这种表现为可行能力不平等的不正义必须进行矫治,包括对智能技术使用中的可行能力弱势者给予包容性赋能和共情式补偿。
