京津冀生态环境协同法制的实现路径

The Path to Realize the Cooperative Legal System of the Ecological Environment in Beijing,Tianjin and Hebei

京津冀生态环境协同法制的目标体系由改善区域环境质量、推动区域生态环境法制的内洽与协调、实现利益均衡和利益共享、推动生态环境保护与经济社会协同发展四个相互关联的环节构成。为有效解决京津冀区域的生态环境问题,需从体制协同、制度协同和实施协同三个层面展开制度设计。基于府际协调机制的体制协同,要求建立中央主导的协同治理模式,按照生态要素设立专项协同治理机构,构建顺畅的生态环境协同治理沟通机制。以利益衡平为主旨的制度协同,要求进一步完善环境规划、事前评估、生态补偿、转移支付、税收分享等制度和机制。在法制实施方面,应破除行政壁垒、加强信息共享,并在推动立法协作、改进绩效考核、加强社会参与等方面协同推进。

The goal system of the Beijing-Tianjin-Hebei ecological environment collaborative legal system consists of four interrelated links:improving regional environmental quality,promoting internal negotiation and coordination of regional ecological environmental legal systems,achieving benefit balance and benefit sharing,and promoting ecological environmental protection and coordinated economic and social development.In order to effectively solve the ecological and environmental problems in the Beijing-Tianjin-Hebei region,it is necessary to carry out system design from three levels:system coordination,institution coordination and implementation coordination.The system coordination based on the inter-governmental coordination mechanism aims to cope with the challenges of territorial management,assessment mechanism and benefit balance distribution mechanism.Institutional coordination based on interest balance aims to achieve a sound level,complete content,and regionally coordinated institutional system.In terms of the implementation of the legal system,administrative barriers should be broken down,information sharing should be strengthened,and coordinated progress should be made in promoting legislative collaboration,improving performance appraisal,and strengthening social participation.
