摘要
生物风险不同于传统损害,来源多样,具有广泛性、不确定性、潜伏性。风险预防原则兼具现实与法律基础,弥补了预防为主原则末端治理的缺陷。在处理好风险行政与法律张力关系的基础上,针对生物风险的不同来源构建生物风险监测制度,完善生物风险评估的技术基准,建立科学、顺畅的预警体系,拓宽公众参与渠道,实现从后果控制到风险预防的转身,有助于实现生物风险的全过程管控。
Biological risks are different from traditional damages,which have diverse sources,universality,uncertainty and potential.The principle of risk prevention has both realistic and legal basis,which makes up for the defect of the end treatment of the principle of prevention first.On the basis of handling the tension between risk administration and law,we should build a biological risk monitoring system for different sources of biological risks,improve the technical benchmark of biological risk assessment,establish a scientific and smooth early warning system,broaden the channels of public participation,and realize the transformation from consequence control to risk prevention,which is helpful to realize the whole process control of biological risks.
