摘要
知情权以经营者的信息披露为实现前提,是消费者的基础性权利。信息的不完整、不对称驱动立法者采用扩张式的立法策略,对消费者知情权进行增容迭代。但在智能时代,扩张性立法并不能提升消费者产品与服务信息的获取、理解和处理能力,反而增加了冗余信息接收成本、专业知识理解障碍和信息价值转化技术困难,进一步加剧了经营者和消费者之间的信息不对称。以政府负责、社会协同、公众参与、法治保障、科技支撑的多元共治理论为理念,通过信息智能推送、同伴式用户评价、信用体系协同创立和多元权利救济体系构建,建立工业4.0时代信息可自决、可解释、可评价、可救济的标准,推动消费者知情权体系的全新变革。
Consumers’right to know,which is based on the information disclosure of merchants,is of the basic rights of consumers.Incomplete and asymmetric information drives legislators to adopt expansionary legislative strategies,and to expand and iterate consumers'right to know as usual.But in the AI era,expansionary legislation can’t improve consumers’ability to acquire,understand and process product information.On the contrary,it increases the cost of receiving redundant information,the barriers to understanding professional knowledge and technical difficulties in transforming information value,thus further aggravating the information asymmetry between businesses and consumers.Based on the theory of multi governance supported by government responsibility,social coordination,public participation,legal protection and science and technology,through the intelligent push of product information,peer user evaluation,cooperative creation of credit system and construction of multi rights relief,the standards of self-determination,interpretability,evaluation and relief of information in the industry 4.0 era should be established to promote a brand new change in consumers'right to know.
