On the Basic Propositions of Criminal Law in System Theory

社会学系统论为刑法学提供了新的思想资源。按照社会学系统论的观点,全社会经历了功能分化的过程,刑法是社会诸功能系统中的一员,功能是维持规范性的行为期待,刑法的运作机制是运作上封闭与认知上开放并与其他社会功能系统存在结构耦合的关系。犯罪论体系应当按照功能目的进行建构,刑事正义发挥着偶连性公式的作用。

The sociological system theory provides new ideological resources for criminal law. According to this theory, the society has experienced the process offunctional differentiation. Criminal law is a part of the social function systems and its only function is to maintain the normative expectation of behaviors. The operation mechanism of criminal law is operationally closed and cognitively opened, and structurally coupled with other social function systems. The system of crime theory should be constructed according to the function of criminal system, and criminal justice plays the role offormula for contingency.
