高等学校大学生管理工作中的法律问题

Discussion on the Legal Problems in Student Management in Colleges and Universities

随着依法治国的深入推进,法治观念已深入人心。在此背景下,大学生与高校法制层面的矛盾纠纷不断出现。通过对目前高等学校与学生之间的民事法律关系、行政法律关系和特别权利关系等进行探索,发现引起我国高等学校学生管理工作存在问题的主要原因是中国传统思想的深远影响以及我国教育法律法规制度的不完善。因此,提出通过完善国家法律,建立学生司法救济制度,依法制定学校自治法,坚持以学生为本、依法治校等措施以避免和解决校生之间发生的矛盾。

With the progression with law-based governance of the country,the concept of rule of law has taken root in people's minds.In this context,the contradictions and disputes between college students and universities on the legal level are constantly appearing.This study mainly introduces the civil legal,administrative law and special rights relations between university and university student.The analysis of the causes of problems in management work for college and university students is found to mainly be the profound influence of the traditional Chinese thought and the imperfection of the education law.Thus,the national law is put forward to be perfected,and student judicial relief system should be established,the school autonomy could be also formulated.These measures are likely to gradually avoid the contradiction between university and university students.
