校园欺凌的软法治理研究——以欺凌概念为逻辑起点

摘要 欺凌行为事实存在于社会各阶层和人们的各年龄段,然而这一现象附加到学生这一特殊群体中,就尤为引起社会关注。校园欺凌的概念是讨论治理策略时必须首先面对的,但是学界对此莫衷一是。综合相关政策和国内外研究,从行为主体、行为方式、时空特征这三个角度来分析和认识校园欺凌区别于其他行为的特殊之处,尝试给出校园欺凌的定义。对于未成年人事务的治理应遵循法治保障原则,以教育和保护为第一位的价值目标,在认清相关概念的基础上,思考校园欺凌行为治理应有的软法思维。
