职工过劳死予以工伤认定的适用问题探析

Analysis on the Application of Worker’s Work-related Injury Identification on Workers’Death from Overwork

目前,我国有关的司法解释、法规及规章尚未明确"过劳死"的范围以及能否认定为工伤的标准。在实务审判中也存在同类型案件出现不同认定标准的问题。伴随着"过劳死"现象和相关劳动争议案件的增多,明确"过劳死"的工伤认定标准,既是保护劳动者权益的迫切需要,也是完善社会治理的重要部分。

The relevant judicial interpretation,regulations and rules of our country have not defined the scope of"death from overwork"and whether it can be regarded as the standard of industrial injury at present.There is also the problem of different identification standards in the same type of cases in practical trials.With the increase of"death from overwork"phenomenon and related labor dispute cases,it is not only the urgent need to protect the rights and interests of workers,but also an important part of perfecting social governance to make clear the standard of industrial injury identification of"death from overwork".
