论我国成年人协议监护制度之构建

On the Construction of China's Adults Custody Agreement System

成年人协议监护制度是在世界人口老龄化问题日益严峻,尊重并保障被监护人的自主意志与自我决定权的人权思想获得世界各国普遍认可的国际背景下应运而生的一种全新的监护种类。为了满足社会生活需要,顺应时代发展,我国《民法典》第33条规定了成年人协议监护制度。该制度在我国尚处于起步阶段,《民法典》的规定过于笼统简要,不具有实际可操作性。因此,应结合我国实际情况,借鉴美日等发达国家有益的立法经验,使我国的成年人协议监护制度能够得到广泛适用和有效实施。

With the issue of the aging of the world's population is becoming increasingly serious,and the human rights idea of respecting and protecting the ward's autonomy and self-determination is universally recognized by all countries in the world,the adult custody agreement system is a brand new type of guardianship.In order to meet the needs of social life and conform to the development of the times,the article 33 of China's Civil Code stipulates the adult custody agreement system.However,this system is still in its infancy in China,and the provisions of the Civil Code are too general and concise,and are not practical.Therefore,it should combine with the China's actual situation and learn from the useful legislative experience of developed countries such as the United States and Japan,so that China's adult custody agreement system can be widely applied and effectively implemented.
