论我国立法规制代孕的价值及其方向

On the Value and Direction of Regulating Surrogacy by Legislation in China

就其伦理本质而言,代孕是一种违反人性且违背生育正义的反伦理行为,应当为立法禁止,但目前我国立法还没有做到全面禁止代孕。这成为代孕在我国泛滥的主要原因。在我国,立法规制代孕的价值在于通过立法为人们在代孕问题上提供一种官方的、权威的并且能提供具体方向的价值判断标准,避免社会在代孕的价值判断上出现分裂,引致人类伦理道德失序。而立法全面禁止代孕的价值则在于,为人类辅助生殖技术应用提供一种更为理性和负责的代孕规制立场,以确保人类辅助生殖技术健康发展。我国立法规制代孕需要向全面禁止代孕的方向发展,无论是生育立法、刑法还是民法均应参与其中,并协同发挥各自的作用。

As far as its ethical nature is concerned,surrogacy is a kind of anti-ethical behavior against humanity and reproductive justice,which should be prohibited by legislation.This has become the main reason for the proliferation of surrogacy in China.In China,the value of regulating surrogacy by legislation lies in providing people with an official,authoritative and specific value judgment standard on surrogacy,so as to avoid social divisions in the value judgment of surrogacy that might lead to an ethical and moral breakdown of humanity.The value of legislating a total ban on surrogacy is to provide a more rational and responsible stance on the regulation of surrogacy for the application of human-assisted reproductive technology,and to ensure that human-assisted reproductive technology moves in a more rational direction.In order to regulate surrogacy in China,it is necessary to ban surrogacy in an all-round way.
