技术标准制定与实施中的专利情报分析研究——以5G标准为例

Research on Patent Intelligence Analysis in Technical Standard Setting and Implementation:Taking 5G Standardization as Example

[目的/意义]技术标准已成为国际经济和科技竞争的制高点。随着专利意识的提高,申请专利已成为创新主体保护其创新成果的主要手段,技术标准制定已基本无法避免采纳专利技术,标准相关专利情报分析已成为行业共性难点问题。[方法/过程]文章通过识别标准制定与实施过程中各利益相关方的典型分析场景,基于过程方法解析标准制定与实施中专利情报分析的输入输出和基本活动,提炼出标准制定与实施中的专利情报分析基本过程。在此基础上,以5G标准为例,提供标准化活动相关专利情报分析的实证研究。[结果/结论]文章能够为解决标准与专利结合中的利益平衡和风险防范问题所需的专利情报信息和决策支持提供分析方法。

[Purpose/significance] Technical Standards have become the commanding heights of the international economy and technology competition. With the patent protection awareness raising,to apply for a patent has become a major means of innovation organization to protect its innovations. Drafting technical standards has been almost impossible to avoid the adoption of patented technologies. Patent related with standard search and analysis is very difficult and becoming very critical in standardization. [Method/process] The research method is to identify the profiled typical scenarios of the stakeholders and extract the basic patent analysis processes by detailing input,output and activities based on process method. On this basis,taking 5 G standards as example to provide an empirical research. [Result/conclusion] The method can provide patent information and decision-making support to balance interests of stakeholders in standardization and prevent relevant risks.
