论传统医药知识保护的基础和机制

On the Foundation and Mechanism of Protection of Traditional Medicine Knowledge

传统医药知识是传统文化和知识财富的重要组成部分。为应对全球化带来的文化帝国主义和跨国医药公司“生物剽窃”的风险,有必要构建传统知识保护的特别权利机制。应设立传统知识权,并明确其权利主体、客体、内容及范围,同时借助专利、商标和其他非知识产权保护方式,形成多元保护路径,以保障我国传统医药知识的存续、发展和创新,进而提升中华民族文化认同,增强文化自信。

Traditional medicine knowledge is an important part of native culture.To cope with the threat of cultural imperialism and bio-piracy,it is necessary to establish the sui generis right protection mechanism.Combining with the patent,trademark and other non-intellectual protection methods,we should set up the“traditional knowledge right”as well as clarify its subject,object,content and scope,so as to construct the multiple protection path,guarantee the sustainability,development and innovation of traditional medicine knowledge,increase the cultural identity of the Chinese nation and strengthen the cultural confidence.
