摘要
在法学教育中,法律诊所教学与理论讲授相对应,以培养学生法律的“实践性”与“应用性”为导向。但是,我国法律诊所教学长期面临师资短缺、经费不足、案源匮乏的困境。审视他国教学经验,如通过与法律援助结合扩大经费支持;积极扩展第二课堂;丰富诊所教学的培养目标等手段,对我国具有借鉴意义。由于线上教学具备进一步整合师资配置、压缩经费支出、丰富案件来源等多项优势,为我国法律诊所教学提供了改革契机。在法律诊所教学从线下转移至线上后,可以采用线上法律服务、线上实务训练、线上实务经验分享等多种途径进行诊所教学,以突破原有的局限。同时,还应积极促进校际合作平台建设、加强线上教学信息的安全保障,以促进线上教学改革顺利进行。
In legal education,corresponding to theoretical teaching,legal clinic teaching is oriented to cultivating law major students’“practice”and“application”.However,legal clinic teaching in China has long faced the dilemma of shortage of teachers,insufficient funds and lack of case sources.Looking at the teaching experience in other countries,they have abundant measures and methods in legal clinic teaching,such as,expanding financial support by combining with legal aid,actively expanding the second classroom,enriching the training objectives of clinic teaching and other means.All these measures and methods have reference significance for legal clinic teaching in China.Online teaching has many advantages,such as further integration of teacher allocation,reduction of expenditures,and enrichment of case sources.It provides an opportunity for reform on legal clinic teaching in China.With the transformation of legal clinic teaching from offline to online,various methods such as online legal services,online practical training,and online practical experience sharing can be employed to break through the previous limitations.In the meantime,a cooperation platform among universities and colleges is suggested to be established,which cannot only improve the teaching activities but also guarantee the security of online teaching information.With these improvements,the progress of online legal clinic teaching can be smoothly made.
