摘要
立法工作者是法律职业共同体不可或缺的一员。然而,当前的法学教育无法在法律知识、法治思维、立法技术以及职业伦理等方面有针对性地提升立法工作者的职业能力。究其原因,主要是当下的立法工作者培养活动存在学科定位偏低、课程开设不足、教材侧重理论、师资力量薄弱以及教学方法单一等问题,并导致立法工作者人才培养与立法实践需求严重脱节。为了解决上述问题,可以采取提高立法学学科定位、强化立法学相关课程、编写立法学实用教材、优化立法学师资队伍以及丰富立法学教学方法等措施改善我国的立法工作者人才培养工作,进而推动建立一支正规化、专业化、职业化的立法工作者队伍。
Legislators are the indispensable members in the community of legal professions.However,the current legal education is unable to improve the professional capabilities of legislators in terms of legal knowledge,rule of law thinking,legislative technology and professional ethics.The primary reason lies in that the current legislators'cultivation and training have problems,such as low subject position,insufficient curriculum programs,theory-focused teaching materials,weak teaching faculties,and solitary teaching methods.This has led to serious disconnections between the cultivation of legislators and the actual demand of legislative practice.In order to solve these problems,a series of measures are provided by the author of this article,including improving the subject position in the science of law,replenishing relevant courses and programs on legislation,compiling practical teaching materials,optimizing the teaching faculties,and enriching the teaching methods.With these measures,the improvement of the cultivation of Chinese legislators and the establishment of a specialized and professional legislator team can be expected.
