检察机关对公安派出所侦查监督机制的优化路径

The Optimizing Path of Procuratorial Organs to the Investigation and Supervision Mechanism of Police Departments

人民检察院是我国的法律监督机关,依法履行对公安机关和人民法院在司法活动中的监督职能。目前,公安派出所承担了大量的刑事案件的侦查工作,检察机关对派出所的侦查监督也受到了普遍关注。但在司法实践中,侦查监督机制的运行表现出认知差异、立法不完善、监督信息渠道缺乏、手段单一、人事和物质资源配置匮乏等一系列共性问题。基于此,针对共性问题展开实证研究并提出优化路径,对于各地根据不同情况建立切实有效的监督机制具有积极的促进意义。

The People’s Procuratorate is the legal supervision agency and supervises public security organs and people’s courts in judicial activities in accordance with the law.At present,local police departments are responsible for the investigation of a large number of criminal cases,and the investigation and supervision of the police station conducted by the procuratorial organ has also received widespread attention.However,in judicial practice,the operation of the investigative supervision mechanism shows a series of common problems including cognitive differences,imperfect legislation,lack of supervision information channels,simplified means,and lack of personnel and material resources.Therefore,carrying out empirical research on common problems and proposing optimized paths will play a significant role on the establishment of effective supervision mechanisms in various places according to different local situations.
