论民事抗诉与再审检察建议之关系协调

Coordination between Civil Protest and Retrial Procuratorial Suggestion

2012年修改后的《中华人民共和国民事诉讼法》将再审检察建议以立法的形式确定了下来,改变了以往检察机关适用再审检察建议无法可依的状况。但法律规定的同一性使得如何界定民事抗诉与再审检察建议的适用范围,如何保障两种监督方式的协调运用,成为检察实践中的热点问题。为更好地贯彻落实修改后的民事诉讼法,推动再审检察建议在实践中的良性、有效运行,应从再审检察建议与抗诉区别适用的因素、二者宜适用的监督范围、再审检察建议对民事抗诉作用之补强及二者之相互补强等方面进行研究,并完善这两种监督方式在民事检察监督中的衔接运作。

The Revised Civil Procedure in 2012 has established the rehearing procuratorial proposal in the form of legislation,which changed the situation that the previous procuratorial organs cannot be relied upon in applying the rehearing procuratorial proposal.However,the identity of legal provisions makes it a hot issue in procuratorial practice on how to define the scope of application of civil protest and retrial procuratorial suggestions and how to ensure the coordinated application of the two supervisory methods.To better implement the revised civil procedure law and promote the benign and effective operation of the retrial procuratorial proposal in practice,this paper discusses the factors in the application of the retrial procuratorial proposal and the protest,the appropriate scope of supervision of the two,the strengthening of the civil protest by the retrial procuratorial proposal and the mutual reinforcement.Thispaper probes into the joint operation of the two supervision methods in the civil procuratorial supervision to contribute to the application of the two supervision methods.
