我国社区居家安宁疗护法制化研究

Research on Legalization of community home-based hospice care in China

分级诊疗背景下开展社区居家安宁疗护服务,是保障公民"善终"权益的重要途径。社区卫生服务中心是提供社区居家安宁疗护服务的重要主体。目前我国社区居家安宁疗护存在立法不健全、安宁疗护专业人才"量"少且"质"不高及部分服务项目无法收费等问题。通过借鉴国内外在政府主体责任、转诊制度、人才培养与资格认证以及服务项目收费制度等方面的立法及实践经验,提出适合我国国情的社区居家安宁疗护法制化建议,促进我国社区居家安宁疗护事业健康发展。

Under the background of hierarchical diagnosis and treatment,community home-based hospice care service is an important way to guarantee the right of citizens to a"good death".Community healthcare center is an important part of providing community home-based hospice.At present,there are some problems in community home-based hospice care in China,such as an imperfect legislation,low quantity and quality of hospice care professionals,and the inability to charge for some services.By drawing on domestic and foreign legislation and practical experience in the main responsibilities of the government,referral system,talent training and qualification certification,and service item charging system,we propose a legal system of community home-based hospice care that suits our country's national conditions,so as to promote the healthy development of community home-based hospice care in China.
