摘要
诊所法律教育方式的引进,弥补了传统法学教育模式在培养高层次法律人才中的固有缺陷,能够切实提高法律硕士研究生的法律职业能力,因此是一种别具特色且行之有效的教学模式。诊所法律教育既开拓了实践性法学教学的方法,又为法学实践教学指引了改革路径。针对法律硕士研究生开展诊所法律教育,能够有效达成法律硕士的培养目标,又符合研究生管理体制,与法学专业本科生开展法律诊所教育相比具有无法比拟的优势。但是,诊所法律教育在运行中同样也面临着难以克服的困境,严重影响了课程实施的效果,阻碍了法律硕士研究生法律实务操作能力的提高。只有突破目前的障碍性因素,寻求比较可行的对策措施,法律诊所教育才能不断发展,培养应用型、实践型的高素质法律人才的目标才能实现。
The introduction of legal education in clinic makes up the defects of the traditional legal education model in the cultivation of high-level legal talents,and it can effectively improve the legal professional ability of graduate students of law with master's degree.Therefore,it is a unique and effective teaching mode.Legal education in clinic not only develops the practical teaching method of law,but also guides the reform path for the practical teaching of law.To carry out legal education in clinic for such students can not only effectively achieve the training goal,and it is also in line with the postgraduate management system.It has incomparable superiority for undergraduate students.However,the legal education of clinics also faces some difficulties in operation,which seriously affects the effect of the implementation of the course and hinders the improvement of the legal practice operation ability of such students.Only by breaking through the current obstacle factors and seeking more feasible countermeasures can the legal clinics continue to develop,so that the goal of cultivating applied and practical high-quality legal talents can be realized.
