论党内法规制定中的专家参与--以提升党内法规制度执行力为视角

On the Participation of Experts in the Formulation of Laws and Regulations of CPC--From the Perspective of Improving the Implementation of Laws and Regulations of CPC

科学立规是提高党内法规制定质量的内在要求,而党内法规制定过程中的专家参与是科学立规的重要方式之一。党内法规制定过程中的专家参与具有"一体两翼"的价值,保障党内法规制定的科学性是专家参与的本质意义,提高党内法规的制定质量、维护党内法规体系的统一性和权威性,是专家参与的价值表现,是科学性的两个内涵。现行党内法规中可以找到专家参与的规范依据,但专家参与的范围过窄、形式单一、参与效用不高等问题严重制约着其参与效果。为此,应强化全过程、各环节的专家参与从而扩大参与的广度,增强专家的直接参与从而提升参与的深度,把合理化的专家意见转化为具体的党规条款以提升专家参与的有效性。

Scientific establishment of regulations of CPC is the internal requirement to improve the quality of the establishment of regulations of CPC,and the participation of experts in the process of the establishment of regulations of CPC is one of the important ways of the scientific establishment of regulations of CPC.The value of expert participation in the process of making regulations of CPC lies in"one body and two wings".To ensure the scientifc making regulations of CPC is the essential signifcance of expert participation.To improve the quality of making regulations of CPC,and to maintain the unity and authority of regulations system of CPC,are the value expression of expert participation and the two connotations of scientificity.The normative basis of expert participation can be found in the current regulations of CPC.However,the narrow scope,single form and low efectiveness of expert participation seriously restrict its participation efect.Therefore,it is necessary to expand the scope of participation by strengthening the degree of involvement of experts in the whole process and all links,to enhance the depth of participation by increasing the direct participation of experts,and to improve the efecttiveness of expert participation by transforming reasonable expert opinions into specifc rules.
