Difficulties in Criminal Enforcement against Crimes Involving COVID-19 Prevention Materials and Countermeasures

在打击涉防疫物资犯罪刑事执法过程中,出现法律适用、案件定性、刑事执法等方面的困难,是新的犯罪形势和手段带来的挑战、立法跟进不及时、侦查力量与犯罪形势不相匹配等原因造成的,可以通过完善立法或出台相关的司法解释、明确规则标准,坚持实质性认定原则,贯彻宽严相济的刑事政策,加强社会宣传、增强防范意识,加强线索经营和阵地控制、强化全链条打击,加强部门协作、强化打击合力等方式应对。

In the process of criminal enforcement against crimes involving COVID-19 prevention materials,many difficulties such as the application of laws,the determination of the nature of the cases,and the criminal enforcement have arisen.The causes for these difficulties include challenges brought by new criminal situations and methods,lagging legislation,the investigative power unfitting the criminal situations,and so on.To cope with the above problems,we need to take the countermeasures as follows:clarify rules and standards through perfecting legislation or enacting relevant judicial interpretations;adhere to the principle of substantive determination;implement criminal policies that are both lenient and strict;strengthen social publicity and enhance awareness of prevention;strengthen clue management,position control and strike across the whole chain;enhance departmental coordination and joint combat forces.
