正当防卫之限度标准研究综述

A Review of the Studies on Limit Standard for Justifiable Defense

随着正当防卫在司法适用上面临的新困境与新问题,正当防卫制度成为现阶段刑法理论研究之热点,正当防卫制度适用的标准问题又为其中的重点。防卫制度之适用以防卫者防卫行为的限度标准为核心,因此,从正当防卫制度防卫限度的适用标准入手,对正当防卫制度适用的限度问题作综述性研究,分析防卫限度标准问题研究之概况,能更加深刻地理解我国现行正当防卫制度适用标准问题,从而对后续学者们研究正当防卫制度有所裨益。

With the emergence of new difficulties and problems in the judicial application of justifiable defense,the justifiable defense system has become a hot topic in present theoretical studies,and the standard for the application of this system is the priority.The application of the justifiable defense system is centered on the limit standard for a person’s act of defense.Therefore,starting from the applied limit standard for the justifiable defense,we make a general study on the limits for the application of China’s justifiable defense system.Sorting out and analyzing the studies on the limit standard for justifiable defense may be helpful to a deeper understanding of the applied standard for China’s justifiable defense system and other scholars’ subsequent studies in this field.
