我国反腐败举报制度的现状与完善建议

Research on Current Situation and Improvement of Anti-corruption Whistleblowing System in China

群众举报为反腐倡廉工作提供了更广阔的视野。经过二十余年的发展,我国举报工作的规则流程逐步细化,初步形成了检察机关与纪检监察机关并行、官方举报和民间举报并重的反腐败举报制度。但是,在举报内涵界定、法律制度设计、举报人权利保障方面我国反腐败举报制度仍然存在一定问题。为规范举报机制,建议设立举报领域的纲领性文件,整合反腐败举报工作机构。同时,在加强举报人的权利保障方面,建议强调举报人提前保护,严惩打击举报人的行为,并细化举报奖励措施。

Whistleblowers provide a broader horizon for the anti-corruption work.After more than 20 years of development,the procedures of whistleblowing in China are gradually refined.China has initially formed an anti-corruption reporting system in which procuratorial organs and discipline inspection and supervision organs collaborate with each other,attaching equal importance to both official and non-official reports.However,the mechanism of anti-corruption whistleblowing in China still has some problems in terms of the definition of whistleblowing,the design of legal systems and the protection of whistleblowers’rights.It is suggested to set up a programmatic document in the field of whistleblowing,and integrate the agencies of whistleblowing in anti-corruption,so that the mechanism of whistleblowing can be standardized.In order to strengthen the protection of the whistleblowers’rights,it is suggested to emphasize the early protection of the whistleblowers,severely punish the revenge on the whistleblowers and refine the reward measures for whistleblowing.
