美国《音乐现代化法案》及其对我国数字音乐版权保护的启示

摘要 随着"互联网+"时代的到来,音乐产业正在经历着传统模式的转型,即从以磁带、CD-ROM等为音乐主要载体的实体模式,向以数字音乐为主的"PC端浏览器+MP3"等网络数字模式转变。与此同时,数字音乐与传统音乐相较所具备的特性也使得其版权保护问题备受关注,对现存版权制度提出新的挑战。美国《音乐现代化法案》的出台,无疑被视为当代最重要的音乐版权立法改革,开辟了数字化时代音乐版权保护的新篇章。文章解读了美国《音乐现代化法案》在音乐作品传统许可模式上进行的一系列的突破和创新,剖析了法案如何对音乐版权保护进行现代化改造,同时该法案对我国数字音乐版权许可模式的规范具有一定的借鉴意义。 With the arrival of the "Internet +" era, the music industry is experiencing the transformation of the traditional mode, that is, the physical mode with tape, CD-ROM and other music as the main carrier, to the digital mode with digital music as the main "PC browser MP3" and other network digital mode transformation. At the same time, the characteristics of digital music compared with traditional music have also caused the issue of copyright protection to attract attention and pose new challenges to the existing copyright system. The promulgation of The Music Modernization Act in the United States is undoubtedly regarded as the most important contemporary legislative reform, opening a new chapter in music copyright protection in the digital age. This paper explains a series of breakthroughs and innovations in the traditional licensing mode of music works in the American Music Modernization Act, and analyzes how the act modernizes the protection of music copyright, while the bill has certain reference significance to the standardization of digital music copyright licensing mode in China.
