摘要
从《合同法》到《民法典》时代,理论与实务界对擅自转租合同效力的认定各不相同。本文研究认为:在保证不损害出租人合法利益之前提下,尽可能地维护擅自转租合同的效力、衡平各方当事人利益、促进经济之发展,应当成为擅自转租合同效力认定与利益衡平规则的制度宗旨。
From the Contract Law to the Civil Code era,the theoretical and practical circles differ in the identification of the validity of unauthorized subletting contracts.This article maintains that:without prejudice to the legitimate interests of the lessor,maintaining the validity of the unauthorized subletting contract as much as possible,balancing the interests of all the parties,and promoting economic development should be the rules for determining the validity of the unauthorized subletting contract and the balance of interests.
