公平竞争审查的地方实施机制研究

Research on the Local Implementation Mechanism of Fair Competition Review

为构建统一、开放、公平的市场竞争机制,防范地方政府破坏市场竞争,我国开始推行公平竞争审查。由于公平竞争审查依赖于要被规范的行政部门的自我贯彻落实,加之公平竞争审查还会涉及多个主体之间的协作,科学、合理的实施机制对公平竞争审查的严格落实极为必要。因应国务院要求,不少地方制定了公平竞争审查实施方案。对96份公平竞争审查方案有关联席会议召集人、多部门联合发文的审查机制、责任机制等细节的考察发现,各地落实公平竞争审查的速度和所制定实施方案的质量都有较大差异。为更好地发挥公平竞争审查约束地方政府行为的作用,除《反垄断法》修订时应当予以回应外,还需修订《立法法》,将公平竞争审查嵌入到对地方立法的合法性审查之中。

In order to build a unified,open and fair market competition mechanism and prevent local governments from disrupting market competition,my country has begun to imp lement fair competition review.Since the fair competition review relies on the self-implementation of the adm inistrative department to be regulated,and the fair competition review also involves the collaboration between multiple subjects,a scientific and reasonable implementation mechanism is extremely necessary for the strict implementation of the fair competition review.In response to the requirements of the State Council,many places have formulated implementation plans for fair competition review.A review of the details of the 96 fair competition review plans related to the conference convener,the review mechanism of multi-department joint publications,and the responsibility mechanism found that there are big dif ferences in the speed of implementing fair competition reviews and the quality of the implementation plans formulated.In order to better play the role of fair competition review in restraining local government behavior,in addition to responding to the amendment of the Anti-Monopoly Law,the Legislation Law needs to be revised to embed fair competition review into the review of the legality of local legislation.
