摘要
通过对劳务派遣法律规制与实践之间的关系考察发现:法律规制是一回事,劳动实践又是另外一回事。在劳动实践中通行并发挥作用的规则,并不完全等同于书本上的劳动法律。如何从理论上理解并解释该现象以及如何分析其成因并提出有建设性意义的对策是我们关注并解决的问题。从法律社会学的角度,运用“行动中的法”的理论分析了劳务派遣法律规制的修改、实施问题,揭示了劳务派遣法律规制表达与实践之间的背离现象并予以理论化和类型化,进而从立法和法律实施两个角度分析了产生这一现象的原因,即劳务派遣法律规制的不足,影响了法律规制的实施效果;弱化的行政执法,造成了法律规制效果的低下;“双轨制”用工制约了法律规制实施效果,三方之交易行为规避法律条款,架空了法律规制。
By examining the relationship between legal regulation and practice of labor dispatch,we find that legal regulation is actually deviated from labor practice.The current rules working in labor practice are not exactly the same as the labor laws in books.It deserves our concern and solution as to how to understand and explain this phenomenon theoretically and how to analyze its causes and propose constructive countermeasures.From the perspective of sociology of law,and with the theory of“law in action”,the revision and implementation of legal regulation of labor dispatch are analyzed herein.The phenomenon of deviation between the expression and practice of legal regulation of labor dispatch is revealed,theorized and typified,and causes for this phenomenon are then analyzed from the perspectives of legislation and law implementation,namely:the lack of legal regulation of labor dispatching affects the implementation effect of legal regulation;the weakening of administrative law enforcement results in the low effect of legal regulation;the“dual-track”employment restricts the implementation effect of legal regulation,and the transaction behavior of three parties circumvents the legal provisions and renders the legal regulation unfeasible.
