随着高等教育办学规模的扩大与资金来源渠道的拓展,这一领域兴办落地的PPP项目也呈逐年递增的趋势。但社会资本的逐利性与高校公共服务"公益性"的矛盾导致运营过程中的纠纷时有发生。通过提高项目实施主体的管理能力,严格合同的拟定与审查,重视"履约保函"的约定,建立多层次的项目风险防范机制是目前高等教育领域PPP项目的主要法律保障策略。

With the expansion of the scale of higher education and the expansion of sources of funds,public private partnerships(PPP)projects in this field are also increasing year by year.However,the contradiction between the profit seeking nature of social capital and the"public welfare"of public service in universities leads to disputes in the operation process.The legal guarantee of PPP projects in the field of higher education is to improve the management ability of the project implementation subject,strictly draw up and review the contract,attach importance to the agreement of"performance guarantee",and establish a multi-level project risk prevention mechanism.
