摘要
国企医院改制过程中在医院、职工、国家三个主体间形成的医院与职工、医院与国家间的冲突最为明显。医院与职工的冲突主要表现为医院聘用与职工就业间的冲突及职工经济利益与医院成本控制间的冲突。医院与国家的冲突主要体现在医院改制与国有资产保护间的冲突及医院自主经营与国家发展规划间的冲突。我国现行对于上述冲突的利益平衡制度存在忽视医院聘用职工的自主权、对职工经济补偿不足、对国有资产保护不力、忽视医院自主经营权等问题。应坚持分配正义原则并完善利益分配规则以实现利益平衡、解决利益冲突。
In the process of state-owned enterprise hospital reform, the conflicts between hospital and staff, hospital and country are the most obvious. The conflicts between hospital and staff are mainly manifested in the conflict between the hospital’s employment and the staff’s work, as well as the conflicts between the staff’s economic interests and the hospital’s cost control. The conflicts between hospital and country are mainly reflected in the conflict between the hospital restructuring and the protection of state-owned assets, as well as the conflict between the hospital’s independent operation and the national development plan. There are some problems in the current interest balance system in China, such as neglecting the autonomy of hospital employees, insufficient economic compensation for employees, unfavorable protection of state-owned assets, and neglect of hospital autonomy. In order to realize the balance of interests among the subjects and solve the interest conflicts in the reform, we should adhere to the principle of distribution justice and improve the rules of interest distribution.
