政府视域下行政批复的类型化研究

On the Classification of Administrative Reply from the Perspective of Government

由于传统认知将行政批复界定为内部行政行为,导致其社会知悉度不高而较少得到应有关注,其实在法治行政意涵上,行政批复具有层级监督的行政行为属性和多维效力面向,是推进法治政府建设的重要渠道。近几年实证考察江苏省政府公布的行政批复样本,发现行政批复在文件中占比较为突出和行政批复类型、行政规划较为集中,且越来越受到基层行政机关的重视,在没有法律法规依据的情况下成为应对新情况或者疑难复杂问题的重要依据。进行学术追问,可知行政批复类型实践具有格式的简单化倾向、类型运行具有程序的平面化样态、类型公开具有选择的随意化偏好。遵循法治政府建设的功能主义进路,可从行政批复功能价值实现的类型区分、类型差异化的程序规范、类型差异化的公开方式三个方面探寻法治行政的实践路向。

Traditional cognition defines administrative reply as an internal administrative act,which leads to low social awareness and less attention.In fact,in terms of the administrative rule of law,administrative reply has the administrative behavior attribute of hierarchical supervision and multi-dimensional effectiveness,which is an important channel for advancing the construction of a government under the rule of law.An empirical study of the samples of administrative replies published by Jiangsu Provincial People's Government in recent years finds that the number of administrative replies takes up a higher proportion and the type of administrative planning is more prominent,which is increasingly paid attention to by grassroots administrative agencies,and become important references for solution of difficult and complex issues in the new condition when lacking legal and regulatory basis.Through further study,it can be seen that the administrative reply type practice has a tendency of format simplification,the type operation has a planar style procedure,and the type disclosure has a preference for random selection.Following the functionalist approach of the government construction under the rule of law,the practical direction of the rule of law administration can be explored in three aspects,the type distinction of the realization of the functional value of administrative reply,the procedural normalization of type differentiation,and the way of public disclosure of type differentiation.
