摘要 互联网时代下,MOOC教育新模式俨然已成为一种新型教育模式。著作权的立法宗旨即实现著作权人和社会公众的利益平衡,著作权人的利益和MOOC制作者的利益需要合理分配。为使结论更具有操作性和科学性,采用案例分析的方法,以现有案例为研究对象,在现有理论框架下提出如下解决方案:MOOC制作者使用在先作品适用法定许可,同时确定支付报酬的计算方法,将区块链技术与著作权集体管理组织制度融合,引入高校图书馆和制作者合作机制。 In the Internet era,the new mode of MOOC education has become a new mode of education.The aim of copyright legislation is to balance the interests between copyright owners and the public,so the interests of copyright owners and MOOC producers need to be reasonably distributed.In order to make the conclusions more operational and scientific,the method of case analysis is adopted,and the existing cases are taken as the research object.The following solutions are proposed under the existing theoretical framework:The legal license was used when MOOC producers use prior works,and the calculation method of payment shall be determined.Blockchain technology shall be integrated into the system of copyright collective management organization for centralized and unified management,and the cooperation mechanism between university libraries and producers shall be introduced.
