因公益需要提前收回海域使用权属于行政征收中的公益征收。在提前收回海域使用权行政补偿案件中,起诉人与提前收回海域使用权行政补偿行为之间具有利害关系,是审查认定原告资格的核心要求;适格被告应确定为批准用海的县级以上人民政府;作为法定收回事由的“公共利益”主要涉及免缴海域使用金的用海项目,部分涉及重要国计民生利益的减交海域使用金的用海项目等。应依法重点审查补偿程序中公告与通知等环节,通过确认违法和撤销补偿决定等方式,审查监督行政机关正确履行程序要求。对海域使用权的行政补偿以直接补偿中的金钱补偿为主;涉及具体养殖的,应结合养殖品类及当地实际情况确定补偿标准;补偿范围限于权益人的财产损失,可适当考虑海域使用权人未来需要抵御的风险等因素。
