摘要
介绍了我国征地补偿标准的历史沿革,分析了现行区片综合地价法存在公平补偿原则含义不明、土地增值收益缺位、市场价值体现不充分等问题,通过借鉴法国、德国、美国的立法经验,提出了国外补偿标准对我国的启示;厘清公平补偿原则实质为完全补偿,要求损益对等;明确土地增值收益的分配,预补偿应得部分给被征地人;优化补偿标准,适用相对市场价格标准,以土地使用权、土地经营权的市场流转价作为参考,以市场方法将部分土地增值收益纳入评估之中。
The historical evolution of compensation standard for land acquisition in China was introduced.Some problems such as the unclear meaning of the principle of fair compensation,the absence of land value-added income and the insufficient expression of market value were analyzed.Drawing lessons from the legislative experience of France,Germany and the United States,the enlightenment of foreign compensation standards to China was put forward.It is clarified that the principle of fair compensation is in essence complete compensation and requires equal profit and loss.The allocation of land appreciation income should be clarified,and the part of pre compensation should be given to the land expropriated.The compensation standard should be optimized,and the relative market price standard should be applied.The market circulation price of land use right and land management right should be taken as reference,and part of land appreciation income should be included in the evaluation by market method.
