“互联网+”时代,电子商务交易频繁,构建电子商务纠纷在线仲裁制度日益迫切。电子商务纠纷在线仲裁有比较明显的优势。目前需要解决的问题主要包括在线仲裁具体的流程设计、在线仲裁的制度化与规范化等方面。要从在线仲裁协议的达成,在线仲裁人员的选任、申请和受理、审理和裁决、裁决执行等方面完善工作流程,并制定统一规则,促进电子商务纠纷在线仲裁的制度化与规范化;另外,需加大宣传力度,提高其公信力和影响力。

In the era of“Internet+”,with the increasing frequency of e-commerce transactions,it has become increasingly urgent to build an online arbitration system for e-commerce disputes.Online arbitration of e-commerce disputes has obvious advantages.The issues that need to be resolved mainly include:the specific process design of online arbitration,the institutionalization and standardization of online arbitration,and the improvement of the credibility and influence of online arbitration.In order to promote the institutionalization and standardization of online arbitration of e-commerce disputes,it is necessary to improve the workflow from the following aspects:the conclusion of online arbitration agreement,the selection of online arbitrators,the application and acceptance,the hearing and adjudication,and the enforcement of adjudication;in addition,we need to increase publicity to improve its credibility and influence.
