论社会诚信的司法维护

On the Judicial Maintenance of Social Integrity

作为社会的一项基本道德诉求,诚信是维系社会正常运行、经济健康发展的前提,也是实现中国梦不可或缺的价值基石。目前,我国社会出现了诚信缺失现象,重要原因之一就是社会诚信司法维护的缺位。社会诚信的司法维护要以社会主义核心价值、社会主义法治精神以及提高社会管理法治水平为追求目标;以司法公信、褒诚奖信以及两个效果统一为基本原则;以注重法律与道德的互动、强化欺诈失信行为的惩戒、建立非判决诚信维护机制以及形成亲诚信的司法判断基准为主要途径。

As a basic moral appeal of society,honesty is the prerequisite for maintaining the normal operation of society and the healthy development of the economy.At the same time,it is also an indispensable cornerstone of value for realizing the Chinese Dream.At present,there is a phenomenon of lack of integrity in our society.One of the important reasons is the absence of judicial maintenance of social integrity.The judicial maintenance of social integrity should pursue the goals of socialist core values,the spirit of socialist rule of law as well as the improvement of the rule of law in social management.Its basic principles include judicial credibility,commendation,and the unity of the two effects.Besides,emphasizing the interaction between law and morality,strengthening the punishment of fraudulent and untrustworthy behaviors,establishing a non-judgment integrity maintenance mechanism,and forming pro-integrity judicial judgment benchmarks are the main ways of its realization.
