摘要
确定“诚信政府”之要求,应依据我国司法实践,不应遽然采行大陆法系传统的信赖保护制度或源自英国的合法预期保护制度。司法实践要求行政机关不得随意变更授益性具体行政行为、按照先前行政行为作出新的行政行为、按约履行协议以及变更规范时应考虑当事人的信赖利益。我国实践接近信赖保护制度,其更易于为我们所借鉴。针对司法实践的不足,应就具体行政行为、规范性文件、行政协议分别明确行政机关所负的诚信义务,确定不同行为产生诚信义务的前提。
The establishment of the criteria for determining an“honest government”should be based on China's judicial practice,and should not simply adopt the traditional trust protection system of the civil law system or the legal anticipation protection system derived from the United Kingdom.Judicial practice requires that administrative agencies not arbitrarily change specific administrative acts that grant benefits,make new administrative acts in accordance with previous administrative acts,perform agreements in accordance with contracts,and change norms after taking the trust and interests of the parties into careful consideration.China's practice is close to the trust protection system,which is easier for us to follow.In view of the shortcomings of judicial practice,it is necessary to clarify the fiduciary duty of the administrative agency in terms of specific administrative actions,normative documents,and administrative agreements,and determine the precondition of the fiduciary duty of different acts.
