摘要
在我国实行二元制土地所有权结构的大背景下,“小产权房”随之出现,但是其合法化问题一直备受争议。由于我国目前法律仍不够健全,对小产权房的解决办法也仅有拆迁补偿、税收与禁入、部分合法与全部合法四种思路,目前也仍处于设想阶段。深圳、北京的小产权房问题最为突出,主要原因是城市房价的不断攀升。小产权房的开发与出售是小产权房开发商和政府进行博弈之后收益最大的选择,这也使得小产权房问题的解决难度日益加大。由于小产权房的种类较多,涉及人群较广,在效益最大化的基础上,应采取因地制宜的分类解决途径以得到有效治理。
Under the background of dual land ownership structure in China,"house with limited property rights"appeared,but its legalization has always been controversial.As the current law of China is still not perfect,there are only four ways to solve this problem:demolition compensation,tax and prohibition,partial legalization and full legalization.The problem is the most prominent in Shenzhen and Beijing,mainly due to the rising price of urban housing.The development and sale of house with limited property rights is the most profitable choice after the game between developers and the government,which also makes it increasingly difficult to solve the problem.Because there are many kinds of house with limited property rights and a wide range of people,we should take the classified solutions according to local conditions to get effective governance on the basis of maximizing the benefits.
