摘要
特殊干预权行使的实质是为了更好地维护患者的根本利益,其存在具有伦理渊源及法理价值,对保护患者生命健康权、维护他人及社会的利益有重大意义,但目前我国对于之的立法不够明确,其适用范围存在争议。本文结合医疗实践来分析学界对之的相关讨论,确定“特殊干预权”概念以及适用条件,期有助于消除医师行使该权时的后顾之忧。
The essence of the exercise of special intervention right is to better safeguard patients'fundamental interests.Its existence has ethical origin and legal value,and it is of great significance to protect patients'right to life and health and safeguard the interests of others and the society.However,at present,China's legislation on special intervention right is not clear enough,and its application scope is controversial.Based on the medical practice,this paper analyzes the relevant discussions in the academic circle,and determines the concept and applicable conditions of the special intervention right,so as to help eliminate doctors'worries when exercising the right.
