摘要
本文论述了临床实践中知情同意权与生命健康权之间的冲突及其原因,提出应进一步完善相应医疗法律法规,细化医方特殊干预权的启动条件,以找到患者生命权与知情同意权的最佳平衡点,实现法律秩序整体的正义。
This paper discusses the conflicts between informed consent right and life and health right in clinical practice and the causes,and puts forward that the corresponding medical laws and regulations should be further improved,the starting conditions of the special intervention right of the medical party should be refined,so as to find the best balance between informed consent right and life and health right,and realize the overall justice of the legal order.
