摘要
河长制作为一项行政系统内部的创新制度,在水污染治理上取得了实际的成效,同时也存在着严重的弊端——高度依赖人治、考核问责缺乏监督。为了使该制度不沦为短期运动式治理的手段,长久地为水污染治理发挥作用,就要完善其中的公众参与机制,牢固制度的基石。通过对河长制中公众参与的法律法规进行研究以及对目前各地方的实践现状进行归纳分析,笔者发现:从现阶段来看,公众参与河长制存在无人负责的空白参与、缺乏法律依托的无序参与、低水平的末端参与的问题。因此,河长制中的公众参与机制需要从明确责任主体、加强法律保障、提升参与水平进行多角度完善,以此推动河长制长效、健康地发展。
As an innovative system within the administrative system,River Chief System has achieved practical results in water pollution control.However,there are also serious drawbacks,such as high reliance on human governance and lack of supervision in assessment and accountability.In order to prevent the system from becoming a means of a short-term campaign-style governance method,and play a role in water pollution control for a long time,it is necessary to improve the public participation mechanism and strengthen the cornerstone of the system.Through the research of the laws and regulations of public participation in the river chief system and the summary and analysis of the current practial status in various places,the author found that:at the current stage,public participation in the river chief system has the problems of blank participation without any responsibility,disorderly participation lacking legal support,and low-level of termial participation.Therefore,the public participation mechanism in the river chief system needs to be improved from multiple perspectives,such as clarify the responsible subject,strengthen the legal protection,and enhance the level of participation,so as to promote the long-term and healthy development of the river chief system.
