摘要
在分析疫情对国际工程项目影响的基础上,结合国际惯例和FIDIC条款,具体分析承包商针对疫情的索赔权力、索赔性质和内容、索赔可引证的合同条款及索赔程序,并就承包商应对疫情影响及索赔提出对策建议。
Based on the analysis of the effect of Covid-19 on international projects,with reference to international practice and related stipulations in FIDIC conditions of contracts,this paper analyzes the contractor’s entitlement to claim related to the Covid-19 pandemic,the nature and content of claim,the clauses applicable for claim,and the procedure of claim,and proposes some advice to the contractors for coping with the effects of the pandemic.
