乡村振兴战略下农村宅基地“三权分置”权能实现路径研究

Research on Ways to Realize the Separation of Three Rights in Homestead under the Background of Rural Revitalization Strategy——Take Zhenjiang as an Example

农村宅基地“三权分置”改革是落实乡村振兴战略的重要手段,也是实现乡村振兴的关键制度创新。各地依据本地特点开始积极探索和丰富“三权分置”的具体实现形式,然而,各地在开展改革宅基地“三权分置”政策实践过程中遇到了诸多困难。2019年镇江市政府工作报告中指出,深化农村土地制度改革,推进农村宅基地“三权分置”试点。结合镇江地区在实施“三权分置”改革实践中存在的法律困境及成因,设计出科学合理的具体路径,旨在促进农村宅基地“三权分置”权能的实现,深化农村土地制度的改革,从而真正实现城乡融合发展。

The“three-rights separation”reform of homesteads is the basic platform and promote the implementation of rural revitalization strategy,and it is the key institutional innovation to effectively respond to the priority development of agriculture and rural areas and realize rural revitalization.Based on local characteristics,localities have begun to actively explore and enrich the specific implementation forms of the“three rights separation”.However,various localities have encountered many difficulties in the implementation of the“three-rights separation”policy of reforming homesteads.The 2019 Zhenjiang Municipal Government’s report pointed out that the reform of the rural land system should be deepened and the project of the“three-rights separation”of rural housing land should be promoted.Combining with the legal dilemma and causes in the implementation of the“three-rights separation”reform in Zhenjiang area,a scientific and reasonable specific path should be designed to promote the realization of the“three-rights separation”powers of rural homesteads and deepen the rural land system.we can truly realize the integrated development of urban and rural areas.
