我国现行有效的反垄断法建立在传统实体经济基础上,对于互联网经济下的经营者集中缺乏及时、有效的应对,导致在申报标准、相关市场界定和限制性条件选择等方面陷入了执法困境。有必要分析困境形成的根本原因,探求经营者集中控制的调适方法。应在营业额标准的基础上纳入交易额标准和弹性机制;在传统相关市场界定方法上增加多层次相关商品市场界定和大数据相关市场界定;在限制性条件方面完善结构性条件的选择和行为性条件的适用。

The anti-monopoly law in our country is based on the traditional entity economic foundation,and lacks timely and effective response to the concentration of operators under Internet economy,which leads to the law enforcement dilemmas in the aspects of declaration standard,relevant market definition and restrictive condition selection.It is necessary to analyze the causes of the formation of the dilemmas to explore the solutions.The transaction standard and flexible standard mechanism should be incorporated on the basis of turnover standards.The definition of multi-level relevant commodity market and big data relevant market should be added to the traditional relevant market definition methods.In the aspect of restrictive conditions,the selection of structural conditions and the implementation of behavioral conditions should be improved.
