党内监督执纪“四种形态”间程序衔接规制探讨

Discussion on the Regulation of Procedure Cohesion among the “Four Forms” of Supervision and Discipline within the Party

监督执纪"四种形态"为处置不同程度的违纪违法对象,界分党纪违反、职务违法与职务犯罪的判断标尺。在实然程序运行之过程中,监督执纪"四种形态"间程序衔接客观存在裁量空间,不仅导致处置效果呈现"入罪"或"出罪"倾向,更可有碍实体公正之实现。从程序适用衔接上,监督执纪程序转换应满足"法律保留"与"程序法定"之要求。在党规与国法协调衔接过程中,党规制定与解释主体应遵照党内法规、监察法以及刑事诉讼程序的一般性规律。善化党内法规纵向的立规制定与解释权,细化监督执纪衔接监察调查过程中有权主体的程序处置标准,补充监督执纪负责人异地办案及程序回转规定,丰富程序选择之必要说理依据,从而自内而外优化程序衔接之再监督效能。

The"four forms"of supervision and discipline are the yardstick for judging disciplinary violations,duty violations and duty crimes.In the process of actual procedure operation,there is objective discretion space in the procedure connection among the four forms of supervision and discipline,which not only leads to the disposition effect showing the tendency of"committing a crime"or"committing a crime",but also hinders the realization of substantive justice.From the connection of procedure application,the change of supervision and discipline procedure should meet the requirements of"legal reservation"and"legal procedure".In the process of coordination and convergence between Party rules and national laws,the main body of Party rules formulation and interpretation should follow the general laws of Party internal laws,supervision law and criminal procedure.We should improve the vertical formulation and interpretation right of the Party’s internal laws and regulations,refine the procedural disposal standards of the right subjects in the process of supervision and discipline connection and investigation,supplement the regulations on handling cases in different places by the person in charge of supervision and discipline,and enrich the necessary reasoning basis for procedure selection,so as to optimize the re-supervision efficiency of procedure connection from the inside out.
