论知识产权海外维权援助体系的构建

On the Construction of Overseas IPR Protection Assistance System

为解决知识产权国际市场中的信息不对称困境,我国有必要建设相应的知识产权海外维权援助体系,为本国企业提供帮助。现阶段,我国政府主导下的援助机制功能单一,缺乏协调;市场主导下的援助机制则缺乏稳定性。结合美国、韩国等国的做法,建议我国知识产权海外维权援助体系的构建采取集中式的体制,由国家知识产权局牵头整合资源,明确各政府部门的定位,发挥行业协会的能动性。与此同时,还应当在主要贸易伙伴国内建立援助机构的海外分支机构,构建常态化、周期性的审查机制,对本国企业分类指导与差异化施策,并探索建立知识产权保险和互保基金。

To solve the problem of information asymmetry in the international market of intellectual property,it is necessary for China to build an overseas IPR protection assistance system to provide help for domestic enterprises.At present,China’s government-led assistance mechanisms has only simple function and lack coordination,while the market-led assistance mechanisms are unstable.With reference of the practices from the United States,South Korea and other countries,the construction of China’s overseas IPR protection assistance system should adopt a centralized one,with China National Intellectual Property Administration(CNIPA)leading the integration of resources,clarifying the responsibilities of various government departments,and giving play to the initiative of industry associations.At the same time,there is a need to establish the overseas branches of such agencies in major trading partners,a regular and periodic review mechanism,classifi ed guidance and differentiated measures for domestic enterprises,and intellectual property insurance and mutual insurance funds.
